Antitrust & Regulatory
The RULG - Ukrainian Legal Group (RULG) attorneys have vast experience advising international companies on major global and regional deals involving antitrust and regulatory issues in Ukraine. To date, we have enjoyed a 100% success rate in obtaining antimonopoly clearances from the Antimonopoly Committee of Ukraine (AMC), and often succeed in obtaining clearance ahead of schedule because of the high quality of our filings. We have assisted our clients with a wide range of issues, from conducting initial analyses of antimonopoly issues, to obtaining prior approval from the AMC, to negotiating settlements with the AMC in complicated antitrust cases.
Our firm is a founding member of the CIS Competition Support Association, which includes leading legal experts on antitrust issues from around the CIS region and works closely with the antitrust authorities of the CIS countries. We participated in the inaugural meeting of the Association in Bishkek on 17 June 2009, where we presented the legislative alert on the latest developments in the antitrust legislation in Ukraine.
Our firm has authored the Ukraine section of the Comparative Summary of Antitrust Laws in the CIS Economic Region - The Practical Guide, published by the CIS Leading Counsel Network ("LCN") Publications. The latest version of the Ukraine section from the Second Edition, 2012, is available here
We were invited by the United Nations Development Program (UNDP) to conduct training sessions on antitrust and competition compliance issues for Ukrainian judges from all across Ukraine under the UNDP - European Commission Project "Reform of Arbitration Courts and Support to Court Administration". In the course of this work, we have prepared Ukraine-focused presentations for annual "Compliance, Law and Ethics Day" antimonopoly compliance training sessions held by a major multinational client. Our firm also conducted interactive Q&A sessions, "Dos-and-don'ts" exercises, risk assessments, gave practical advice on compliance in dealings with business partners (distributors, customers, etc.) and competitors, and covered liability issues, relations with regulators and many other issues.
We pay special attention to antimonopoly compliance and frequently draft relevant provisions (price-setting, establishing a system for paying bonuses, and avoiding restrictions on market access, coordinated actions, discrimination, etc.) to be incorporated into retail distributor agreements by our multinational wholesale clients, consulting our clients' managers on the importance of antimonopoly compliance.
According to PLC Which lawyer? Yearbook, RULG is "recognized" in the competition/antitrust area. Our President, Dr. Irina Paliashvili has been included in the U.S. based Best Lawyers® list of leading lawyers as the best lawyer in the antitrust area for Ukraine.
